Terms of Use
Knack (formerly Love Wizard) is provided by Open Sesame Education.
Knack is a mobile application designed to provide personalized dating advice and coaching to its users, leveraging the capabilities of artificial intelligence. By using the app, users can ask dating-related questions and receive AI-generated responses tailored to their unique situations and preferences. In order to provide this service, the app collects data such as age, gender, sexual orientation, dating goals, and any additional input provided by the user.
By accessing or using the Knack mobile application, you agree to be bound by these Terms of Use ("Terms"). Please read these Terms carefully before using the app, as they contain important information about your legal rights and obligations.
1. Acceptance of Terms
By accessing or using the Knack mobile application, you agree to be bound by these Terms of Use and our Privacy Policy, which is hereby incorporated by reference. If you do not agree with these Terms or our Privacy Policy, you must not access or use the app.
2. Privacy Policy
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, protect, and disclose your personal information and data when you use the Knack mobile application. By using the app, you agree to the collection and use of your data in accordance with our Privacy Policy.
3. Eligibility and User Representations
By using the Knack app, you represent and warrant that:
- You are at least 18 years old, or the legal age of majority in your jurisdiction, whichever is greater;
- You have not been previously suspended or removed from the app;
- Your use of the app does not violate any applicable law or regulation;
- You have the right, authority, and capacity to enter into this agreement and to abide by all of the terms and conditions of these Terms of Use.
4. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Knack app solely for your personal, non-commercial use.
5. User Content and Conduct
When taking and uploading screenshots to Knack, we require you to have the necessary permissions and consents from all parties involved. This means, you as the uploader will assume full responsibility for obtaining proper consent from any third parties involved before uploading any screenshots or other User Content on Knack.
You agree to not use Knack in any way that:
- Is sexually explicit or pornographic, exploits or harms minors;
- Infringes someone else's rights, including intellectual property or privacy rights;
- Propagates hate speech, discriminates, or incites hatred against any individual or group;
- Promotes, supports, or glorifies violence or any illegal activities.
When using the Knack app, you agree not to:
- Provide false or misleading information about yourself or your dating situation;
- Harass, threaten, or defame other users or any third party;
- Engage in any unlawful or inappropriate conduct;
- Attempt to interfere with the proper functioning of the app or its underlying technology;
- Reverse engineer, decompile, or otherwise attempt to derive the source code or underlying technology of the app.
You can report an AI response in the app with the Report response action and select a reason. That action sends the selected response and reason, linked to your account, to us for review. The app asks for AI data-sharing permission before sending content to OpenAI. You can withdraw that permission in Profile → AI data sharing, as explained in the Privacy Policy.
6. Intellectual Property Rights
All content and materials on the Knack app, including but not limited to text, graphics, logos, and the underlying technology, are the property of Knack or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works based on the app or its content without our prior written consent.
7. In-App Purchases and Subscription Services
The Knack app may offer in-app purchases or subscription services. By purchasing or subscribing to these services, you agree to pay the applicable fees and acknowledge that these fees are non-refundable, except as required by law. We reserve the right to change the pricing and availability of these services at our sole discretion.
Where subscriptions are available, purchases are processed by Google Play or the App Store. The purchase screen and the store checkout show the plan, billing period, price, and any eligible trial. Subscriptions renew automatically unless cancelled through the store. Any eligible free trial converts to the displayed paid plan unless cancelled under the store's terms. You can manage or cancel your subscription in your Google Play or Apple account settings, and use Restore purchases in the app to request access to a subscription already associated with your account. Deleting your Knack account does not cancel a store subscription. Refund requests are subject to the applicable store policy and your statutory rights.
8. Disclaimer of Warranties
The Knack app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
9. Limitation of Liability
In no event shall Knack, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Knack app.
10. Indemnification
You agree to indemnify, defend, and hold harmless Knack, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the app or your violation of these Terms of Use.
11. Termination
We reserve the right to terminate or suspend your access to the Knack app at any time, without notice, for any reason, including but not limited to your violation of these Terms of Use.
12. Governing Law and Dispute Resolution
These Terms of Use are governed by the laws of the jurisdiction in which Knack is located, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of the Knack app shall be resolved through arbitration, with the prevailing party being entitled to recover its reasonable attorney's fees and costs.
13. Changes to the Terms of Use
We reserve the right to change these Terms of Use at any time, in our sole discretion. We will notify you of any material changes by posting a notice within the Knack app or by sending you an email. Your continued use of the app after any such changes constitutes your acceptance of the new Terms of Use.
14. Miscellaneous
These Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and Knack regarding your use of the app and supersede any prior or contemporaneous agreements, communications, or proposals, whether oral or written, between you and Knack. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
